LEGAL NOTICE OF THE WEB PLATFORM – BE MATE
1. ABOUT THE TERMS OF USE OF THE PLATFORM: ACCEPTANCE, MODIFICATIONS, AND VALIDITY
These general conditions regulate the use of the services associated with the web platform www.bemate.com (hereinafter, the “Platform”), owned by BE MATE COMMUNITY SPAIN, S.A.U. (hereinafter, “BE MATE”), with CIF A87035838, registered office at C/Serrano, 8 – 2 DR, Madrid (28001) – Spain, registered in the Commercial Registry of Madrid, Volume 32409, Folio 35, Section 8, Sheet 583346. Among the services associated with the Platform are those provided through its “Business Traveller” section (https://www.bemate.com/business-traveller/), by the company BEMATE CORPORATE, S.L., with NIF B-88047535, CICMA 3781, registered office at C/ Serrano, 8, 2 DR, Madrid (CP 28001 registered in the Commercial Registry of Madrid, Volume 37.384, Folio 36, Sheet M-666.533, belonging to the same business group as BE MATE, being applicable the Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, and Royal Decree-Law 23/2018, of December 21, transposing directives on trademarks, railway transport, and package and linked travel services.1.1. Platform Users
Browsing and using the Platform confer the user the status of user of the same and implies full acceptance, without reservation, of each and every one of the provisions included in these General Conditions of Use, according to the version published by BE MATE at the time the user accesses the Platform. All users of the Platform must be at least eighteen (18) years old, so the user assumes the responsibility of complying with this condition.1.2. Validity
The declaration of nullity, invalidity or ineffectiveness of any of the terms of use will not affect the validity or effectiveness of the remaining conditions, which will remain binding between the parties. Likewise, the waiver by any of the parties to demand, at any time, compliance with any of these conditions, will not imply a general waiver of compliance with any other condition or conditions imposed, nor will it generate an acquired right for the other party.1.3. Duration
Access to the contents of the Platform has, in principle, an indefinite duration. BE MATE is authorized to terminate or suspend the provision of services or the development of actions through the Platform at any time, although with full respect for the applicable regulations in these cases.2. GENERAL CONDITIONS OF ACCESS AND USE OF THE PLATFORM
Through the Platform, BE MATE provides users with information, requests, access and/or use of services or content (hereinafter, the “Service” or “Services”), developed or made available by BE MATE under the terms and conditions provided in each case.2.1. Free Access and Use
Access and/or browsing through the Platform by users is free, without prejudice to the paid nature of the services that may be made available through the Platform under the terms and conditions established by BE MATE.2.2. Navigation, Registration, and Data Forms
In general, initial access to or browsing of the Platform does not imply or determine the subscription or prior registration of users. However, BE MATE may condition the provision of certain services or access to the content offered through the Platform to the user’s prior registration on it, as well as to the completion by the user of the corresponding data forms. BE MATE reserves the right to unilaterally modify, at any time, the registration system or data forms made available on the Platform for legal, technical, or corporate reasons, or in accordance with any self-regulation process to which it may be subject.2.3. Truthfulness, Accuracy, and Updating of Provided Data
The data entered by users in the corresponding registration forms or data collection forms available through the Platform must be at all times truthful, current, and accurate, and will be processed by BE MATE in accordance with Spanish legislation regarding the protection of personal data (in the case of personal data). The user (or their legal representative) will be solely responsible for any false, inaccurate, or outdated statement made, as well as for any damage caused to BE MATE or third parties as a result of the breach of this duty.2.4. Correct and Responsible Use of the Platform and Services
The user undertakes to use the Platform and the Services reasonably in accordance with current regulations, these terms of use, the specific conditions of the services, the privacy policy, and other notices, regulations of use, and instructions communicated to them, generally accepted morals, good customs, and public order. In case of breach of these commitments, BE MATE reserves the right to exclude, prohibit, or deny access to the Platform and its services, without prejudice to the possibility that BE MATE exercises any legal and/or judicial action it deems of interest regarding its legitimate rights and interests (its own or third parties).3. PROHIBITED USES
Users are PROHIBITED from:- Using any of the services or content available through the Platform for illegal purposes or effects prohibited in these conditions, harmful to the rights and interests of BE MATE or third parties. Unlawful purposes will include, among others, use for profit, commercial use, theft of trade secrets or know-how, promotion, advertising, among others.
- Damaging, disabling, overloading, deteriorating, or preventing the normal use of services through the Platform, as well as carrying out any cyber-attack on the Platform, systems, or associated processes.
- Transmitting, communicating, or making available to third parties information, data, content, messages, and, in general, any type of content that may violate the use of the Platform and/or be contrary to the law.
4. INTELLECTUAL AND INDUSTRIAL PROPERTY
4.1. Intellectual Property of the Website Content
The user undertakes to use the content made available on the Platform, including, among others, texts, graphics, images, icons, technology, software, links, and other digital, audiovisual, or sound content, as well as its graphic design and source code (hereinafter, the “Contents”), in accordance with the law, these terms of use, the specific conditions of the services and other notices, regulations of use, and communicated instructions, as well as generally accepted morals, good customs, and public order. In particular, the user undertakes to refrain from:- Reproducing, copying, distributing, making publicly available, transforming, or modifying the services and contents, without permission from the rights holder or legal permission;
- Removing, manipulating, or altering in any way the intellectual property data or other data identifying BE MATE’s or third party’s rights;
- Exercising or abusing the exploitation rights associated with such content, without express authorization from its legitimate owner and, where applicable, under the expressly agreed conditions.
5. HYPERLINKS
Users and, in general, individuals who intend to establish a hyperlink between their website and the Platform (hereinafter, the “Hyperlink”) must comply with the following conditions:- The Hyperlink will only allow access to the home page of the Platform but may not reproduce it in any way, including the prohibition of reproducing or linking specific content or services without written authorization from BE MATE;
- No frames will be created over the Platform’s web pages;
- No false, inaccurate, or incorrect statements will be made about BE MATE, its senior management, officials, or collaborators, or about the content or services provided;
- It will not be claimed or implied that BE MATE or another third party present on the Platform has authorized the Hyperlink or supervised the services offered;
- The website where the Hyperlink is established will not contain illegal, immoral, or improper information or content, or that infringes on the rights of BE MATE or third parties;
- The establishment of the Hyperlink does not imply a relationship between BE MATE and third parties or acceptance of content or services;
- BE MATE may, at any time, request the removal of the Hyperlink, without prejudice to legal actions.
